Berdasar pengalaman bertransaksi jual beli barang/jasa dg model spt ini, saya cuma saran saja:

Jika
bertransaksi dengan model pembayaran tunda seperti kasus ini, utk
penjual jasa/ barang, penagih sebaiknya menyimpan tanda terima penagihan
asli, baik yg dikeluarkan oleh pihak pengguna barang/jasa, ataupun yang
dikeluarkannya sendiri (jika pengguna mungkin tidak punya format)
dengan baik, agar tidak hilang.

Untuk pembayar, jika telah menyerahkan uang, maka mintalah tanda terima penagihan asli yang dibawa penagih.

Hal
ini untuk mencegah terjadinya penyalahgunaan. karena siapapun yg
membawa tanda terima penagihan asli, berhak menerima pembayaran.

Jika
ada orang menagih
dengan kekerasan, apalagi dengan tidak membawa bukti tanda terima
seperti diatas, laporkan melalui surat pembaca di media massa atau
laporkan pada kepolisian terdekat.

Benarkah Fedex Indonesia Mengerahkan Preman & Meresahkan Masyarakat?

Akhir2 ini ada banyak preman yg mengaku sebagai debt collector dengan
membawa surat kuasa dari Fedex (sebuah perusahaan jasa kargo &
kurir) asal USA. Kedatangan mereka ke pabrik, rumah, kantor dll tempat
yang pernah menggunakan jasa pengiriman melalui Fedex.

Mereka
datang dengan ancaman kekerasan dan menyatakan bahwa mereka disuruh
Fedex untuk menagih jasa pembayaran yang menurut mereka belum dibayar
oleh masyarakat yang pernah menggunakan jasa Fedex. Tapi anehnya yang
ditagih adalah jasa pembayaran, 4tahun,
5 tahun, 6 tahun yang lalu, bahkan lebih.

Bila anggota
masyarakat itu merasa sudah membayar kepada Fedex, maka para preman ini
meminta agar pelanggan tersebut menunjukkan kwitansi pembayaran yg
dikeluarkan Fedex 4, 5, 6 tahun yg lalu. Jika tidak bisa menunjukkan
kwitansi yg
diminta oleh para preman ini, maka dianggap belum membayar. dan jika
tidak mau membayar, tak segan para preman ini melakukan pengancaman,
penekanan, bahkan jika anggota masyarakat yang bersangkutan melawan,
maka bisa terjadi pemukulan, penganiayaan dsb.

Anehnya, jika
anggota masyarakat itu akan menghubungi fedex, maka para preman ini
menyatakan bahwa mereka sudah mendapat kuasa penuh, dan tidak perlu
berhubungan dengan Fedex.

Lebih aneh lagi, jika anggota
masyarakat bisa menelpon ke kantor Fedex setempat, maka biasanya tidak
disambungkan pada pimpinannya, tapi pada staff biasa. dan staff tersebut
hanya mengatakan silahkan membayar, kalu tidak mau membayar silahkan
menghadapi para debt collector tersebut. tanpa mau mendengar argumentasi
dari anggota masyarakat yang bersangkutan, bahwa mereka telah membayar,
hanya karena kwitansi sudah lebih dari 5 tahun ya sangat sulit mencari.
Staff Fedex hanya menganggap bahwa orang sudah membayar jika
mampu menunjukkan kwitansi. Jika tidak bisa menunjukkan kwitansi
pembayaran, meski sudah 7 tahun yang lalu kwirtansi itu, maka
orang/kantor/pabrik tersebut dianggap oleh staff Fedex, belum membayar.
Maka kalau ngotot harus siap dianiaya preman.

Kita tidak
berpolemik, mengenai kenapa Fedex di Indonesia melakukan hal yang
memalukan dan mengarah jadi pemeras seperti itu. Apakah karena mereka
mau bangkrut, atau karena ada opini bahwa uang pembayaran dari
pelanggannya atau masyarakat yang pernah memakai jasa pengiriman Fedex
telah diselewengkan karyawan2nya yang sudah dipecat atau mengundurkan
diri, lalu yang dijadikan kambing hitam adalah bekas para pelanggannya.
Tulisan ini hanya memberi cara bagaimana mengatasi cara preman yang
dilakukan oleh Fedex tersebut.

cara menangkal aksi preman dari Fedex atau orang2 yang mengaku suruhan Fedex tersebut adalah sebagai berikut:

Jika
anda memakai jasa Fedex dan
membayar secara kontan, tentunya anda mendapat kwitansi. tapi misalnya
anda hendak membakar atau membuang kwitansi tersebut, karena anda anggap
tidak berguna, itu adalah hak anda. Apalagi jika itu sudah lebih dari 2
tahun. Seperti anda membeli kulkas/ TV secara tunai, tentunya sangat
aneh jika toko tempat anda membeli tau2 mendatangi anda dan memaksa anda
membayar lagi, karena anda tidak bisa menunjukkan kwitansi 2 tahun yang
lalu.

Jika anda memakai jasa Fedex dan karena anda adalah
pelanggan Fedex yang mendapat kemudahan pembayaran bulanan. maka
tentunya anda menandatangani sebuah tanda terima penagihan yang belum
terbayar, dimana tanda itu yang asli dibawa oleh pegawai Fedex, dan jika
Fedex akan menagih harus membawa tanda itu. Jika anda membayar tentunya
tanda itu harus anda minta lagi, agar tidak ada orang yang menyalah
gunakan tanda itu untuk menagih anda lagi. Selama tidak dapat
menunjukkan tanda terima penagihan yang asli, maka siapapun
tidak berhak menagih dan mengintimidasi anda untuk membayar.

Pabrik
atau kantor tentunya mempunyai prosedur, bahwa siapapun melakukan
penagihan pada pihak mereka, maka mereka mengeluarkan tanda terima
penagihan. Dan dengan membawa tanda penagihan yang asli, beberapa waktu
kemudian barulah si penagih bisa mencairkan tagihan mereka. Tanpa
membawa tanda terima itu, maka siapapun tidak berhak menagih pada
mereka. Karena jika menagih tapi tanpa membawa tanda bukti terima yang
asli, bisa terjadi penyalahgunaan.

Dibeberapa pabrik, misalnya
Tjiwi Kimia di Jawa Timur, Jabeka di Tangerang Banten, rupanya para
preman suruhan Fedex ini juga beraksi. dan mereka biasanya tidak membawa
tanda terima tagihan asli yang menunjukkan bahwa pelanggan atau
masyarakat itu belum membayar kepada Fedex. Mereka selalu memaksakan
kehendak bahwa pelanggan atau masyarakat harus menunjukkan kwitansi
pembayaran jasa pengiriman 5 tahun yang lalu. Jika tidak bisa
menunjukkan, maka mereka berkeras dan memaksa agar membayar. Jika
pabrik atau kantor besar tentunya ada pihak satpam atau security yang
bisa mengatasi mereka. tapi untuk kantor kecil atau pelanggan perorangan
tentunya harus siap2 menghadapi tekanan, ancaman, bahkan penganiayaan
dari para preman tersebut. karena biasanya para preman suruhan fedex 
itu datang sebanyak 4 orang atau lebih.

Untuk itu tulisan ini
menyarankan, sebaiknya jika ada preman suruhan Fedex datang menagih,
tapi tidak bisa menunjukkan tanda terima penagihan ASLI sebaiknya
ditolak. Jika terjadi ancaman, sebaiknya melapor pada polisi.

Persoalan
jika anda sudah membayar seperti jasa pengiriman kantor pos, TIKI dll
lalu kwitansi tidak anda simpan lagi karena anda merasa sudah tidak
membutuhkan lagi, apalagi kwitansi itu sudah berumur lebih dari
2 tahun. Itu adalah hak anda. Jadi tidak benar langkah preman2 suruhan
Fedex memaksa anda membayar lagi jasa kiriman beberapa tahun yang lalu,
karena anda sudah tidak menyimpan kwitansi jasa pengiriman beberapa
waktu yang lalu. Dan preman2 suruhan Fedex itu tidak bisa menunjukkan
tanda terima penagihan ASLI, yang menunjukkan bahwa anda belum membayar.

Bahkan
hampir semua kantor/ pabrik dalam tanda terima penagihan yang diberikan
pada pihak yang menagih, didalamnya sering tertulis bahwa kehilangan
tanda terima ASLI adalah tanggung jawab dari pihak yang menerima tanda
terima. Hal ini karena dengan tanda terima itulah orang baru bisa
mencairkan tagihan.

Lalu kenapa setelah lebih dari 5 tahun, baru
sekarang pihak Fedex tanpa pernah berkomunikasi atau klarifikasi atau
menulis surat menanyakan tagihan, tapi  langsung mengirimkan preman
untuk memaksa menagih ke pelanggan atau masyarakat, dan para preman
datang memaksa menagih pembayaran
tanpa tanda terima ASLI. Apakah dulu masyarakat atau pelanggan sudah
membayar pada pegawai Fedex yang membawa tanda terima ASLI. lalu
ternyata pembayaran itu digelapkan oleh karyawan Fedex yang lalu dipecat
atau mengundurkan diri sebelum aksinya ketahuan? Lalu dianggap
masyarakat atau pelanggan belum membayar tagihan dan harus menanggung
kerugian karena penggelapan yang dilakukan oleh karyawan Fedex yang
tidak bertanggungjawab?  Tulisan ini tidak berpolemik pada hal itu.
Tulisan ini hanya memberi solusi pada masyarakat atau pelanggan bagimana
menghadapi aksi kekerasan yang dilakukan oleh para preman suruhan
Fedex.

Untuk itu pihak kepolisian diharapkan tidak mentolerir
dan menindak tegas aksi para preman seperti ini yang sering meresahkan
masyarakat.

Untuk itu diharapkan juga adanya penjelasan resmi
dari pimpinan Fedex di Indonesia, kenapa melakukan hal yang meresahkan
masyarakat
ini
